Chapter 174 - Stormwater Management
Ordinance No. 601, adopted by the Board of Supervisors on December 21, 2010, combines the requirements of the stormwater management requirements from the existing Subdivision and Land Development regulations (Chapter 185 of the Code of the Township of Derry) and the water quality requirements from Chapter 174 (Stormwater Management) into one chapter of regulations.
The new regulations will become effective upon the addition of the lesser of 5% of impervious lot coverage or 1,000 square feet of impervious lot coverage. Ordinance No. 601, as a freestanding ordinance outside of the Subdivision and Land Development Ordinance, will require any activity that meets the impervious cover requirements to comply with the regulations. That is to say, for instance, that the addition of a residential accessory structure may cause stormwater best management practices (BMP) design and installation. Ordinance No. 601 is similar to the existing Chapter 174 and Chapter 185 as it requires inspections and provides for design requirements, an operation and maintenance (O&M) agreement, review fees, and most elements presently required in one form or another. In addition, the new ordinance will reach a little further to protect the water resources of the Township and will be more encompassing in the control of stormwater volume. It will more specifically require inspections and more comprehensively address review fees. For projects adding in excess of 5,000 square feet of impervious area, as-built drawings will be required.
